In the event of a minor 

I as the (see below related with the minor) hereby consent on behalf of (see below name of the minor) for him/her to engage in activities provided by Sub Oceanic. I further state that I am fully aware of the risks associated with taking part in the activities.I further agree to indemnity and forever release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), its employees, Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries, loss of life or damage to personal property, caused or sustained in connection with the participation ofthe Activities. 

I represent that I have read and fully understand the consequences of signing this statement and have done so voluntarily upon careful consideration.

PLEASE READ CAREFULLY BEFORE SIGNING

This is a statement by which you are informed of established conditions of participation in our diving and snorkelling activities. Your signature on this statement is required. Therefore, kindly read and clarify matters in this statement prior to signing. We will not be liable for any incident that is covered by the conditions of participation once you have signed.

If the Participant is below 18, this form must be signed by a parent or a legal guardian.

CONDITIONS OF PARTICIPATION

1. I (herein referred to as the “Participant”) hereby assume and undertake all risks of injury and/or harm associated with the use of snorkeling and diving equipment and agree to indemnify and forever release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), its employees Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries and or, harm either physical or mental and or loss of life caused in connection with the use of the snorkeling and diving equipment and by engaging in snorkeling and diving.

2. I hereby acknowledge that by signing this condition of participation, I undertake all risks attached to snorkeling and diving on my own.

3. The Participant acknowledges that he/she must strictly follow the directions and instructions of the guide / instructor / divemaster, or he / she may be debarred from any activity without being entitled to a refund. Failure to follow instructions given by the guide/ instructor/ dive master will constitute as the Participant acting on his/her own risk.

4. The Participant is liable for any damage to, or loss of, hired materials, whereby Sub Oceanic is entitled to charge for the loss of earning in condition to repair or renewal costs.

The Participant acknowledges that participation in all diving and snorkelling activities organized by Sub Oceanic is at the Participant’s own risk. The Participant expressly confirms that he / she is physically fit and has no knowledge of any medical reason which makes him / her unsuited for diving or snorkelling. Sub Oceanic is entitled, but not obliged, to require a medical certificate.

5. The purpose of the medical conditions listed below is to confirm whether you should be examined by a physician before participating in diving activities. A positive response to a question does not necessarily disqualify you from diving. A written medical statement is required if any of the following medical conditions apply to you:

The Participant acknowledges that diving and snorkelling are sports that require the equipment to be in perfect condition and working

order. Sub Oceanic regularly maintains the Dive Centre’s diving and snorkelling material. Nevertheless, the Participant should double

check to ensure that all the equipment is in good working order and immediately, prior to going diving or snorkelling, inform Sub Oceanic if any defects are found.

7. The Participant agrees that he / she shall be solely responsible for any personal gear brought to dive or snorkel and Sub Oceanic will not be responsible for the consequences that arise out of the use of such personal gear.

8. The Participant agrees to follow the diving and snorkelling regulations and general safety rules displayed in the dive centre and detailed by PADI & SSI.

9. The Participant shall not enter into water without the consent of the instructor/ guide/ divemaster. Where the Participant wishes to

return to the vessel before end of a dive or snorkel, the Participantshall inform the relevant instructor prior to returning to the vessel. In the event the Participant comes back to the vessel he/she shall inform the instructor/ guide/ divemaster and get approval prior to re-entering the water. Sub Oceanic shall not be liable for Participants entering into water without approval or consent. For clarity, obtaining consent from the boat captain or crew before re-entering water shall not be deemed as obtaining consent from the instructor / guide / divemaster.

10. The Participant agrees that violation of the relevant rules and regulations in any form may lead to a ban from further activities, without being entitled to a refund.

11. A surface interval of 18 – 24 hours before departure by plane is mandatory. Sub Oceanic will not be liable for any risk associated with the Participant’s failure or intentional non-disclosure or provision of false details of the departure flight.

12. Equipment rental must be returned to the Sub Oceanic staff during operating hours (08:00-18:00), within rental frame and not later than 2 hours prior to departure from the island. Equipment not returned will be considered as lost and will be charged accordingly.

13. Please note that Sub Oceanic, its staff and employees, the Hotel Owning Entity, the Hotel and its employees shall not be responsible for any damage or loss of our guest’s own equipment whilst it is in our care. For avoidance of doubt, guests may keep their equipment with us at their own risk.

14. Nitrox users shall, personally analyse the O2 (oxygen) percentage and determine the maximum operating depth based on a maximum partial pressure of oxygen of 1.4 bar.

15. Kindly note our cancellation policy: all activities cancelled after operating hours on the day before will be charged 50% of the price,

cancellations on the same day will be charged 100%.

16. I represent that I have read and understood the conditions of participation. I hereby sign this document voluntarily having carefully considered its consequences.

17. I hereby assume all risk of injury or harm associated with snorkelling and diving and further agree to indemnity and forever release Sub Oceanic, its employees and the Hotel its staff and employees from any liability, claims or demands related to but not limited to any potential injuries, either physical or mental, loss of life or damage to personal property, caused or sustained in connection with snorkelling and dive related activities.

I hereby assume all risk of injury or harm associated with the participation of the Activities and further agree to indemnity and forever release Sub Oceanic Adventures Private Limited (“Sub Oceanic”), its staff and employees, Hilton Amingiri Private Limited (the “Hotel Owning Entity”), its employees, Hilton Maldives Amingiri Resort & Spa (the “Hotel”), its staff and employees from any liability, claims or demands related to but not limited to any potential injuries, loss of life or damage to personal property, caused or sustained in connection with the participation ofthe Activities.
